A follow-up question: Why? (and I don’t imply that it is necessarily a bad idea)
DMS did retain an attorney. At this time we can’t say why. We will make an announcement when our attorney says we should. Thanks for your understanding.
An organization as large as ours it is probably wise to have an attorney on retainer - the retainer basically means we have been retained as a client and when needed have access immediately without “looking around for one.”
If something is being discussed with the attorney it is proper that the BoD limit the scope of need to know on details and if on the advice of counsel they’ve been told to remain keep information confidential at this time then we should respect/trust the BoD and the attorney.
I would recommend, that the details or questions and answers about litigation, or any other confidential legal activity be strictly forbidden from public discussion here by all members, including Board members. You’d be amazed at how much Lawyers love forums.

Texas is very much an open government state, with restrictions that things like city council meetings are open to the public. But consultation with attorneys about pending or possible litigation is one of the few exceptions, because disclosing any details prematurely often substantially hinders your case.
If we talk about it here, we might as well sit down with whoever is on the other side and directly tell them exactly what is said here.

Well I wasn’t interested before but now I am.
Meh. DMS is a 501(c)(3) organization. The discussion could simply be in regards to the finer points of the rules. Even something as innocuous as that should not be discussed on an internet facing forum. I know it’s difficult to believe but federal employees can sometimes be assholes. And, while it can only use paper, the IRS can wield that paper with devastating force.
Soon, we’ll fear any public statement, lest it be used against us in a court (tax or otherwise).

I can’t wait till this topic is cleared up. The more and more DMS grows, the harder it is to even try and keep track of what is going on. I really hope the lawyer is for some stupid issue between members and nothing to do with the current running of the space. But, I share the concerns of others.
