Thankfully, the legal system in Indiana has now resolved these questions by declaring anything using a tortilla to contain/support food is a sandwich.

An Indiana man sued after his plans for a Mexican eatery were rejected because only "a sandwich bar-style restaurant" was allowed.
(saw this story on the news this AM, and amusingly, their poll of viewers was overwhelmingly that tortilla-wrapped food is not a sandwich, so the controversy might be far from over. We’ll keep our eyes on the SCOTUS web site to see if any higher authority will be making decisions on this important topic)
