DMS Questions.pdf (155.2 KB)
My email is [email protected], please feel free to ask follow-up questionsâŚ
I have a couple of follow-ups.
Would it be ok for a member to use DMSâs address as their âhomeâ address for their ID, legal matters, or for their business address?
Would it be ok for a member to use DMSâs address to register a personal vehicle or trailer, or for their car insurance?
Whether yes or no, please elaborate on your reasoning.
I believe that I have already answered this one. I have a vehicle renewal that arrived at DMS and our Board violated federal law by opening my mail and has yet to either return said mail and/or make it available to me, so my follow-up question is âIs it acceptable for an officer (Freddie) to open mail clearly marked to an individual?â
The legal address on that vehicle is in Knoxville, TN; which matches my license, my banking, etc. My physical address was listed as the marina in the Colony, where I reside when in Texas. Since Alan wanted to transfer this title âin personâ at the DMV near DMS, they required a Dallas county local address for the buyer, seller, and/or location the transaction took place. My address was in Denton county, not to mention I can not get mail at the marina and they needed something other than my PO Box and my legal Tennessee address which I provided, so we cited DMS as the address where the transaction took place which allowed that DMV office to handle the transaction. It was not listed as a legal, mailing and/or physical address. DMS was never mentioned/ named, nor is there any illusion that DMS owned, sold, and/or purchased the vehicle. I suspect that required a Dallas county address so that they could collect taxes.
DMS was never mentioned/ named, DMS has taken no liability for this vehicle, DMS was not listed as my residence, and DMS is not where the DMV sent my title. Since my marina does not permit tenant mail and/or packages to be sent to the marina and some vendors will not accept a PO Box. Iâm not even sure that the DMV sent anything to DMS- for all I know this may have been a piece of junk mail to sell me extended warranty or something like that. The fact that Iâm being questioned (repeatedly) about this and I havenât been provided my mail for me to know what/ with whom I need to address the issue is shows that some people would rather âmakeâ an issue, rather than solve/ avoid an issue. This Board talks about âprivacyâ concerns when members make a formal complaint against officers, but they have not shown the same respect to me. I believe that the Board should treat all members with respect, and not play favorites.
I have since confirmed that there is no reference to DMS on my registration, but yet this something like the eighth time I have been asked about this issue. When I went to the DMV in Denton county, they did not show the DMS address associated to my vehicles.
I agree that we can not permit people to live at DMS and/or give the appearance of living at DMS as that is a violation of the City and DMS policies. I also agree that an individual member does not have the legal ability and/or right to enter in any sort of contract on behalf of DMS. Lastly, I feel that using the DMS address in place of a ârealâ address to defraud someone and/or make identification more difficult is wrong. I believe that using DMS as a business address or legal address is not appropriate as it give the impression that DMS may be involved. If a DMS member/ small business owner is doing business from DMS, at the very least, they should get a PO Box and/or use their home address. Our memberships, not unlike a gym, should be treated as âshort-termâ and should not be trusted as a means of official and/or long-term contact.
In my case, none of these things happened. At the time, I had packages which could not go to my PO Box go to DMS, where I typically picked them up the same day. In most cases, the contents of those boxes where used at DMS for projects- this was done with permission; however, I realize that the current Board has reversed the DMS position of allowing members to have non-committee packages delivered to DMS and I have ceased this practice, but at the time- it was known to the (former) Board and done with their permission.
I personally see no issue in shipping items to the space as long as they meet the above criteria, but I have respected the Boardâs position on this matter. If Iâm swapping my brakes out on a vehicle and I have Rock Auto ship to DMS, I do not see where that puts the space at risk and/or makes me a bad member; however, this Board apparently does not feel the same, and the perception is that they are trying to get rid of âbad membersâ. This is one of many policies that have been changed by this Board with little explanation, discussion, and/or notification.
I can not speak to the mail that was apparently spent to DMS because although it has been opened and is clearly known to be mine, this mail has yet to be made available to me.
Instead of simply leaving the envelope on top of the committee mailboxes for me to pick up and/or dropping me a email telling me that I had mail; Freddie choose to break federal law, open my mail, and make accusations/ assumptions to the Board which where simply not accurate. A quick little note would have been enough to address this issue, but instead I have been given ultimatums and threats. I happen to agree with this Board on several issues, but they do not appear to understand âpositiveâ communication and thus I credit this Board for much of the toxicity which many have cited over the past year.
I can provide you with a copy of my Tennessee Driverâs License with my legal Tennessee address; the same ID I provided when purchasing the truck from Alan. In my mind, there really isnât an issue here. The only reason this truck was not registered in Tennessee is because Texas is the state of principle use, and Alan (rightfully) felt that doing the paperwork at the DMV would provide both of us the assurance that the transaction was going to handled properly- a.k.a - Alan wanted to make sure that his liability was terminated, and I wanted to make sure I was getting a clear title. Surely, Alan and I arenât the only DMS members which handled a vehicle purchase at the DMV, and certainly that shouldnât be a violation of DMS policy to conduct safe business practices when dealing with vehicles.
Had you been paying attention at any point in the last year, you would have seen that we have asked people to not send their mail to dms and that any personal mail would be RTS. It isnât our responsibility to make sure your personal mail gets delivered.
No one opened your mail, but you can tell what a TX registration letter looks like from the outside. Further, we only found out your cars were registered to the space after getting warranty renewal calls to the dms voice mail and having to investigate why we were on that list.
Thank you, next.
If a Federal crime was committed why did you not contact authorities? The USPS takes this kind of thing very seriously. Or did you just want to use it as a platform piece at election time?
Because it wasnât, this is just another blue tape baseless accusation.
Nobody opened any mail. A simple public records search shows that this genius doesnât know the difference between home and DMS. The same public record search shows that your registration is out of date. You might wanna look into that.
Iâll give you the opportunity to correct the record here. If you fail to do so, Iâll be happy to file a complaint. You have 72 hours to retract before I file the complaint.
Just curious, Why did you use DMS as your home address for a vehicle?
The funny thing about this accusation is that if people took this candidate seriously enough to engage in actions that caused actual damages to DMS or Freddie, Joe could be sued and easily crushed. Fortunately for Joe, there is no risk of that happening.
Yup a false accusation of mail fraud is pretty serious. He was informed we did a public records request to find the vehicles he has registered with DMS (not just mailing for random docs, actual registrations that were filed). We originally did it because when the DMV mail came, we wondered âwho else might have listed us with the DMVâ turns out you can find out all the vehicles registered to your address through records requests and his were there. No opening of mail required.
Are those records available for review?
Which part of my response to you feel is incorrect?
Joe, please do not spam replies back to back like this.
Answer in one post if youâre answering that fast
I made three responses to three different comments, but you hid my responses and wasted more space here. You lecture on ethics, but yet you are hiding responses from another candidate. As a candidate yourself, do you not see how this is a hypocritical for you to hid my responses, but you you have no issue will responding to my posts telling me how stupid and uninformed I am.
No, you chose to attack Freddie. If the records exist that you registered vehicles with a DMS address your whole tirade is just that, a childish tirade. If you didnât and Freddie did what you said then file a complaint with the proper authorities. I wouldnât want someone in charge of DMS if they are breaking federal laws.
I do this to everyone on this board man. You can reply to multiple people in a single reply, but otherwise youâre spamming the notifications for people watching these threads. You literally sent three replies in the span of one minute, all of which could have been in a single post because all of them were before the first of your three posts. As a candidate, people are watching this thread and that means youâre generating a notification, email, etc for each post.
I asked you to not spam the board; in my replies to you, all points are in one post as are my replies and comments to the others above me.
The guidelines for Talk are located here, and I suggest you read them if you have not already: FAQ - Dallas Makerspace Talk
You have every right to post replies to people, but not to spam the board. You could put all three of those in a single message.
